1. Acceptance of these Terms
These Terms of Service govern your access to and use of Aircraft-Jobs, including its website, accounts, job listings, Aircraft-Jobs Passport, matching tools, communications, and related services (the “Platform”). By creating an account, checking an acceptance box, activating a Passport, or using the Platform, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old and legally able to enter into these Terms. If you use the Platform for a company, you represent that you have authority to bind that company.
2. What Aircraft-Jobs is
Aircraft-Jobs is a hiring-technology platform that helps aviation professionals and employers find and communicate with one another. Aircraft-Jobs is not an employer, staffing agency, recruiter, labor contractor, background-screening company, consumer reporting agency, joint employer, or party to any employment relationship or agreement between a candidate and an employer. Aircraft-Jobs is operated independently from Elite Aviation Staffing and is not responsible for Elite Aviation Staffing’s services, obligations, or activities.
3. Accounts and security
You must provide accurate, current information and keep it updated. You are responsible for your login credentials and for activity under your account. Notify Aircraft-Jobs promptly if you suspect unauthorized access.
You may not impersonate another person or company, create deceptive or duplicate accounts, evade account restrictions, or allow unauthorized users to access employer or administrative features.
4. Candidate Passports and candidate control
Candidates retain ownership of the resumes, credentials, photographs, work history, and other materials they provide. A candidate grants Aircraft-Jobs a limited license to host, process, display, analyze, and share those materials only as needed to operate and improve the Platform, provide matching and hiring features, comply with law, and enforce these Terms.
Candidates control whether their Passport is active and searchable, subject to Platform rules. A Passport imported by an administrator remains unclaimed and non-searchable until the candidate claims the account, reviews the imported information, accepts the applicable terms, and affirmatively activates it. Candidates may request correction, deactivation, or deletion as described in the Privacy Policy and as permitted by law.
Candidates are responsible for the accuracy of their information and may not submit false licenses, certifications, work histories, or other qualifications. Verification labels indicate only the checks described by the Platform; they are not a guarantee of identity, skill, employability, safety, or job performance.
5. Jobs, matching, and hiring decisions
Employers are solely responsible for their job listings, screening, interviews, offers, employment decisions, pay, benefits, workplace conditions, legal compliance, and communications with candidates. Candidates are solely responsible for evaluating employers, jobs, and offers.
Match scores, experience levels, extracted resume information, and recommendations are automated decision-support tools. They may be incomplete or incorrect and do not determine eligibility or guarantee an interview, offer, hire, employee, applicant, or result. Employers must independently review job-related qualifications and must not use the Platform unlawfully or discriminatorily.
Aircraft-Jobs does not conduct consumer reports or employment background checks. An employer that obtains a consumer report or background check is solely responsible for required disclosures, authorization, notices, and compliance with the Fair Credit Reporting Act and other applicable laws.
6. Acceptable use
You may not:
- scrape, harvest, crawl, copy, or bulk-download Platform data;
- sell, resell, publish, distribute, or build an unrelated database from candidate or employer information;
- use candidate information for marketing, solicitation, identity theft, harassment, discrimination, or any purpose unrelated to a legitimate hiring opportunity;
- bypass access controls, view limits, subscription limits, or security measures;
- upload malware, interfere with the Platform, reverse engineer protected portions of it, or use automated systems without written permission;
- post unlawful, misleading, fraudulent, discriminatory, or non-existent jobs; or
- infringe privacy, publicity, intellectual-property, or other rights.
7. Candidate information and employer duties
Employers may access candidate information only for legitimate, job-related hiring purposes and only to the extent permitted by their account and plan. Candidate information should remain within Aircraft-Jobs whenever practical. An employer may move or retain information outside the Platform only when reasonably necessary for a genuine hiring process, after hiring, with the candidate’s consent, or when required by law.
Employers must protect candidate information, limit access to people with a genuine hiring need, and delete or securely dispose of it when the hiring purpose and any lawful retention period end. Additional duties appear in the Employer Terms.
8. Communications
You authorize Aircraft-Jobs to send transactional emails and Platform notices concerning account verification, applications, interviews, offers, security, legal updates, and service administration. Marketing communications, if any, may be managed through the choices provided in the message or account settings. You are responsible for keeping your contact information current.
9. Fees, subscriptions, and taxes
Candidate Passports are free unless Aircraft-Jobs clearly states otherwise. Employer fees, plan limits, renewal terms, and cancellation terms will be disclosed before purchase. Except where required by law or expressly stated at checkout, fees are non-refundable. Employers are responsible for applicable taxes. Aircraft-Jobs may change future prices or features with notice; any written founding-employer commitment remains subject to its stated eligibility and account-good-standing requirements.
10. Intellectual property
The Platform, Aircraft-Jobs name and branding, Passport format, software, workflows, designs, compilations, matching systems, and other Aircraft-Jobs materials are owned by or licensed to Aircraft-Jobs and protected by applicable law. Except for the limited right to use the Platform under these Terms, no rights are transferred to you. Feedback may be used by Aircraft-Jobs without restriction or compensation.
11. Suspension and termination
Aircraft-Jobs may investigate suspected violations and may restrict, suspend, or terminate access; remove content; preserve evidence; or contact appropriate authorities when reasonably necessary to protect candidates, employers, the Platform, or others. You may stop using the Platform at any time and may request account closure, subject to lawful retention and unresolved payment, security, fraud, or enforcement needs.
12. Disclaimers
To the fullest extent permitted by law, the Platform is provided “as is” and “as available.” Aircraft-Jobs disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. Aircraft-Jobs does not guarantee uninterrupted service, data accuracy, candidate or employer identity, qualifications, job availability, communications, interviews, offers, hires, retention, or results. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, Aircraft-Jobs and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, hires, or business interruption arising from the Platform. Their aggregate liability for claims arising from the Platform will not exceed the greater of the amount you paid Aircraft-Jobs during the 12 months before the event giving rise to the claim or $100. These limits do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Aircraft-Jobs and its owners, officers, employees, contractors, and service providers from third-party claims, damages, losses, and reasonable costs arising from your content, job listings, hiring or employment practices, misuse of candidate information, violation of these Terms or law, or infringement of another person’s rights. This section does not require a consumer to indemnify Aircraft-Jobs for Aircraft-Jobs’ own unlawful conduct.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court with jurisdiction in Arkansas, and each party consents to that jurisdiction and venue. Before filing a claim, the parties agree to make a good-faith effort for at least 30 days to resolve it after written notice. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims procedure.
16. Changes and general terms
Aircraft-Jobs may update these Terms. Material changes will be posted with a revised effective date and, when appropriate, presented for new acceptance. Continued use after the effective date constitutes acceptance where permitted by law.
These Terms, the Privacy Policy, and any applicable Employer Terms or checkout terms form the agreement concerning the Platform. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign your account or these Terms without written permission; Aircraft-Jobs may assign them as part of a reorganization, financing, merger, sale, or transfer of the Platform.
